Demotion Request - Fern Gaucho

Firstly i would like to put my side of the story down JOSH said i could and secondly if you pocket printers and kill them IT IS A MUG so fuck off whining on the fourms when you're clearly wrong, your side of the story is biest of what was dictated even Ark almoast warned me for doing the exact same thing so i am entitled to. And me and Jayden don't talk on steam he informed me that the server was mayhem so that was the reason i came on if you want screenshots between me any jayden's chat you can AND after reading all the bullshit you put ALL OF IT was a lie and i never had shown favouritsm Jayden was warned warned aswell and the reason i told you to shut up was because i couldn't say anything without you interfeering so i gagged you to let my words come out and i ungagged you? But you're going on about me abusing you? But the part where you were going off your head at me calling me the shittest admin and fat as fuck? and i kicked Kent like 5 times? i told josh the sides of the story and he told me to go ahead and warn you, and even after i was stoned to get awway form your shit you still kept gonig on about it :/ SO i had josh's approval so stop being such a whinger just because you got warned so stop being a biest prick and making lies up on your side and leaving my side undecided

Although not official, this forum post by Fern states what he believes about the rules of DarkRP and how they should be followed, as well as rules that should be enforced on the server. The excuse of "this isn't official so why mention it?" is not valid against this argument. What information is supplied here in this post is all relevant to the situation simply because it is an expression of your beliefs in the rules, and in turn how you wish to punish those who break them.

What this gives us is an insight into what "Fernandihno Gaucho" believes the rules are and what he believes consequences should be for when they are broken.
This was posted 3 days before the incident leading to this demotion request. The following quotes are from the forum.

1 - "If someone gets shot on the streets any job can steal what he dropped"
        So if Fern believes someone shot on the streets and drops something, then it's just too bad and you have to live with it. So if I were to hold a shipment of 100 guns in my pocket on my way to my base, and I was killed and dropped it, through this logic I cannot complain about it. And even if I did to an admin or mod, they should brush off the matter. To be quite frank, I cannot think of a situation where you would randomly die on the street (excluding being near a raid) without it being considered an RDM, so therefore this rule must be directed at this. So I hold shipments, I get shot and die, hobo comes along and picks it up, and that's the end of it. If this is the belief for being killed with items, what about when the items are physically dropped out of your pocket purposely? Is this different to the killing situation? If you drop a $50 note on the street, then someone runs past and picks it up, what happens? You no longer own the $50. Tough luck. So let's apply this belief to what actually happened, shall we. After all, what we are doing is Role Playing what happens in real life.
        1 or 2 nuclear printers were dropped on the street outside the PD (a public place). This caused people to start shooting everywhere. A thief ran past and picked up the printers, and the man who dropped the printers was killed in the crossfire. The thief was accused of "mugging without adverting," when the items he picked up he found on the street. Now referring back to this belief by the moderator, "If someone gets shot on the streets any job can steal what he dropped," where does this say a mug needs to be advertised? NOWHERE. So why was Kyle punished because of this? Why was this even questioned if this is the case? Why was it followed up by the moderator who publicly made it known that his thoughts on the situation contrasted those of what he showed them to be. It shows he has double standards on the matter which suit him whenever he sees fit, and is contradicting himself. Inconsistent moderating.


2 - "Not racial/homophobic remarks (This will result in instant ban)"
        Although this isn't mentioned in the demotion request, during the discussion about the situation with those involved and the moderator, Kyle Knight was repeatedly verbally abused. This did not faze the moderator Fern for the majority of the discussion, however Jayden Google came out and labelled Kyle a "fat Muslim letterbox c***." I find this language disturbing and utterly disgraceful. There is no need for this type of language and abuse in the world. Although this was not directed at me, I found this extremely offensive and extremely racist. Many in the area, including Kyle (the man it was directed to) made their disgust to these comments known to Fern. I believe this resulted in Jayden being warned, but I heard this exact same sentence uttered by Jayden on at least 3 other occasions. Now please explain how this resulted in him receiving one warn? If the punishment for racial abuse is believed by the moderators and community to be an "instant ban," why was Jayden only warned once? There is an extreme difference between a warning and a banning. After the first time Jayden abused Kyle, he was warned. However on each of the other occasions, nothing was said by Fern. Once again, double standards were shown, and once again he contradicted himself.

Furthermore, Fern went to a player named "Brodie Lad" (a donator, and an obviously a well respected player to be the one source of assistance from a moderator of the server) to explain the situation to him and get his thoughts on the matter, and provided him with a false story, leading to believe Kyle should be punished, along with the men he was "basing" with. However, when he was informed of what actually happened involving the dropping of the printers (which is all written in Kyle's demotion request post), he fast changed his views on the matter and agreed with Kyle. What this shows is:
        1) Fern was dishonest in his retelling of the story as he left out key details to make it seem a mode one-sided affair against Kyle, and;
        2) Fern was unfairly moderating players on the server, choosing a side in the matter and "twisting" the story to make it seem as if the innocent party was actually guilty.
What I see from this is a moderator unfairly treating players, by backing up his friend in a situation in which he was wrong. This may also explain why Jayden was not banned, but only warned, when he disgustingly abused Kyle.

One more issue I'd like to raise while we're here is this no mugging in a public place rule. This makes no sense whatsoever.
The dictionary definition of Mugging is "an act of attacking and robbing someone in a public place." (If you think I'm just making up crap, please Google "Define Mugging" and see).
Key words there, PUBLIC PLACE. If one cannot mug in a "public place," then they are not mugging them at all. Logic tells us this. I think a rule change needs to be made with this, maybe something like "Mugging may only be initiated in a secluded public place" or "deserted public place." It's only logical.

I apologise for the lengthy response, but it was required to get my points out and be made clear to all you who read this. 

+1. ok So on the 8/7/15 at 4.10pm. We were building a base and we owned all the doors other then 2, Then a guy joined and came and owned them and started prop blocking our base so we called fern and he teleported and said it was allowed, because there was a fading door (but there was not a fading door)But there was a noclide infront of the fading so we couldnt lockpick and there was no keypad so we could get out but he still allowed it so i "so what you are trying to say is that i can go and but props in front but peoples doors and it will be alright" he then said "then i wil warn you for it" then i end up saying well why don't you warn him then he warned him but didnt remove the props. then i said i was going on the forums and then he banned him for 20mins. Fern is a great guy but i dont think he is ready for trial-mod, i think he needs to learn more about the rules.

The demotion request is for how long it took fern, you knew he was in the wrong but because you were friends with you delayed the ban and such and avoided me and The Wastelander whenever we called for help.
